A 37-years old Shehu Mohammed has been docked before a chief magistrate Court, Igbosere, Lagos over an alleged armed robbery.
In a four-counts charge preferred against him before Senior Magistrate Doja-Ojo, Shehu Mohammed and others still at large are said to have between May and June 11, 2009 at about 1300 hours along Lagos/Ibadan Expressway, Lagos, conspired together and whilst armed with guns, robbed one Alhaji Muazu Umar and dispossessed him of his N1, 400,000.
Furthermore, the suspect with others still at large were alleged to have on the same date and place, within the Lagos magisterial district, whilst armed with guns, robbed another victim, one Nasiru Mohammed of his N750, 000. The suspect was further alleged to have dispossessed one Shaibu Umar the sum of N320, 000 whilst armed with guns. The court was told that the offences allegedly committed by the suspect are contrary to Section 5(b) and punishable under Section 1(2)(a) of the Robbery and Firearms (Special provision) Act Cap 398 laws of the Federation of Nigeria 1990 as amended.
After preferring the charges, the suspect pleaded not guilty to all the counts. However, the presiding magistrate could not grant him bail, being an armed robbery case. She ordered that the suspect be remanded in prison custody, while awaiting the Director of Public Prosecution’s (DPP) advice. The presiding magistrate adjourned till November 24 2009 for mention.
In another development,the Commissioner of Police on behalf of the people of Lagos has docked five men, namely, Sunday Ihemkpuaba, David Kenechukwu, Samuel Edward, Emmanuel Abazu and Godwin Ashupe before a Chief Magistrate Court, Igbosere, Lagos over allegation of conspiracy, Armed robbery, Kidnapping, impersonation, forgery, stealing and threat to life.
In a ten-counts charge preferred against them before Chief Magistrate A.O Awogboro by the prosecutor, Sergeant Peter Nwangwu, the suspects and others still at large are said to have on April 3, 2009, about 10 am at No 14 Oliyide Street, Unity Road, Ikeja, Lagos, conspired together to commit an offence of kidnapping and thereby committed an offence punishable under Section 516 of the criminal Code Cap C 17, volume 2 laws of Lagos State of Nigeria 2003.
The suspects were said to have at the same date, time and place, within the Lagos magisterial district, unlawfully deprived one Mrs Chinyere Mbachu of her liberty by taking her to unknown destination against her wish. Furthermore, Emmanuel Abazu, David Kenechukwu Ojo, Samuel Edward and others still at large were said to have on January 8, 2009 at about 2 pm at No 1 Yusuf Canade Street, Sabo Ajangbadi, Lagos, conspired together to kidnap and did unlawfully deprived one Mrs Ogomaka Ejiofor and Master Kingsley Ajeriogu of their liberty by taking them away against their wish and detained them.
Besides, the suspects were alleged to have impersonated the Nigeria Police by identifying themselves to Mrs Chinyere Mbachu with a forged Nigeria police warrant card as police officers attached to State CID, Panti, Yaba; Lagos before taking her away into captivity.
Moreover, the suspects were alleged to have conspired at Sabo Ajangbadi to rob with guns on the aforementioned date, time, place and magisterial district, whilst armed with toy pistol and other dangerous weapons, robbed one Toyota Tundra V 8 Pickup Van with registration number RG 941 KJA, valued N2, 700,000, property of one Uzoma Ajeriogu.
The suspects were further alleged to have under threat, demanded and received the sum of N500, 000 as ransom from one Emeka Mbachu under the threat that his wife Mrs Chinyere who was held captive would be killed if he (Emeka) failed to pay the amount demanded.
The prosecutor told the court that the offences alleged to have been committed by the suspects are punishable under Sections 364(2), 516, 517, 109 and 406 of the Criminal Code Cap C 17, volume 2 laws of Lagos State of Nigeria 2003 and also contrary to Sections 5(b), punishable under Section 1(2)(a) of the Robbery and Firearms (Special Provision Act), Cap 398, laws of the Federation of Nigeria 1990 as amended.
After reading the charges before them, the suspects pleaded not guilty and made oral application for bail. Ruling on the bail application, Chief Magistrate Awogboro granted bail to Sunday Ihemkpuaba(1st defendant) and Godwin Ashupe(5th defendant) in the sum of N500,000 each with two responsible sureties each in like sum.
The sureties must show evidence of substantial means of livelihood, must be resident in Lagos and must show evidence of tax payment for the last three years. Both the official and residential addresses must be verified by court.
The other three suspects, David Kenechukwu, Samuel Edward and Emmanuel Abazu are to be remanded in prison custody pending the transfer of their case and arraignment in the High Court.
